The issue focused on national security and military services. The federal government had given political parties broad legal rights to sue law enforcement agencies that posed a threat to national security. Law enforcement officials did not claim constitutional rights in general.

When Justice Department lawyers filed lawsuits against police departments over alleged voter fraud, Attorney General Eric Holder announced he would seek civil suits from prosecutors for violations of laws criminalizing illegal voting. Lawyers say such litigation will likely win little justice because courts have seen no evidence of unlawful voting at all.
