Large-Scale Judgments Based Sentencing Analysis of Drunk Driving Crime

Abstract: Since the crime of drunk driving was include by criminal law in 2011 in China, the number of cases has been increasing. The sentencing of this crime is a light punishment, but closely related to daily life, so its sentencing norm is important. Since relevant judicial interpretations do not specify sentencing standards, judges have more discretionary powers, there is sentencing bias in judicial practice. In the existing empirical analysis, there are problems with few samples and insufficient models and methods. To understand the sentencing norm and influencing factors of sentencing in judicial practice, this paper based on the empirical analysis of more than 500,000 judicial documents, finds out the current situation and problems in the sentencing of this crime and puts forward some suggestions for improvement.
